The EU discloses the draft of the final investigation results on anti-subsidy measures against Chinese electric vehicles

On August 20 local time, the European Commission disclosed to relevant parties the draft decision on imposing final anti-subsidy duties on pure electric vehicles imported from China. This time, the proposed tax rates have been slightly adjusted. For BYD, it is 17.0%; for Geely, it is 19.3%; for SAIC Motor, it is 36.3%; for other cooperating companies, it is 21.3%; and for all other non-cooperating companies, it is also 36.3%. In addition, the EU has decided to implement a separate tariff rate for Tesla as a Chinese exporter, which is currently set at 9%. The European Commission also clearly states that anti-subsidy duties will not be imposed retroactively.

Relevant parties can apply for a hearing to the Commission's services as soon as possible and submit their opinions within 10 days. After that, the Commission will submit the final decision to the member states after considering the opinions of relevant parties. The member states will vote according to the review procedures of the Commission's rules. Unless there is a majority vote against it, the Commission's proposal will be adopted, and this vote is binding.

The final measures must be implemented within four months after the imposition of provisional duties. The Commission's implementing regulation including the final results of the investigation will be published in the Official Journal at the latest by October 30, 2024, and at the longest within 13 months after the start of the investigation. The validity period of any potential measures is five years and can be extended upon reasonable request and subsequent review.

On October 4, 2023, the European Commission launched an anti-subsidy investigation into Chinese electric vehicles. On July 4, 2024, the European Commission announced the preliminary ruling and imposed provisional anti-subsidy duties ranging from 17.4% to 37.6% on Chinese electric vehicles. Now, on August 20, the final ruling is disclosed, and the final ruling will be made by November 4.
